Right of withdrawal

When this right of withdrawal applies

Consumers have a statutory right of withdrawal where the contract was concluded exclusively by means of distance communication, for example by phone, email, WhatsApp or Telegram, or away from our business premises. This applies to the purchase of a vehicle as well as to services around the vehicle, such as a mobile vehicle inspection, air-conditioning service, detailing or chip tuning. If the contract is concluded at a personal appointment on our premises, for example where we agree the scope and the price only when you hand the vehicle over at the workshop and you place the order there, there is no statutory right of withdrawal.

An enquiry through the form on this website is not yet a contract. A contract comes about only once you agree to a specific vehicle or scope of work at a specific price.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

For a contract of sale for a vehicle the withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the vehicle. For a service contract the withdrawal period is fourteen days from the day the contract was concluded.

of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the model withdrawal form set out below, but it is not obligatory.

You can also declare the withdrawal through the withdrawal function on our website (in German). If you use it, we will send you without delay a confirmation of receipt on a durable medium, in particular by email, stating the content and the date and time of receipt.

To meet the withdrawal deadline it is enough that you send your notice before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal. We will use the same means of payment you used for the original transaction unless expressly agreed otherwise with you; in no event will you be charged a fee for this reimbursement.

We may withhold reimbursement until we have received the vehicle back or you have supplied evidence of having sent it back, whichever is the earliest.

You must send back the vehicle or hand it over to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal. The deadline is met if you send the vehicle back before the period of fourteen days has expired.

A vehicle cannot be returned by normal post. You bear the direct cost of returning it, estimated at a maximum of 700 euros.

You are liable for any diminished value of the vehicle only where it results from handling other than what is necessary to establish the nature, characteristics and functioning of the vehicle. A test drive to check the vehicle is covered; use beyond that, in particular a substantial increase in mileage, may give rise to a claim for compensation.

Special rules for services

If you asked us to begin the service during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point at which you notify us of your withdrawal, compared with the full scope of the services provided for in the contract. Refrigerant already filled, parts already fitted, materials consumed and testing, read-out, programming and detailing work already carried out are taken into account.

For a service contract the right of withdrawal expires where we have fully performed the service and began performance only after you gave your express consent and acknowledged at the same time that you lose your right of withdrawal once we have fully performed the contract. We obtain that consent before we start work. If you would rather not give it, we wait until the withdrawal period has expired before carrying the work out.

The check without a visit is the exception: we accept it only if you expressly ask in your request that we begin before the withdrawal period ends.

Exclusion of the right of withdrawal

There is no right of withdrawal for contracts exempted under § 312g (2) BGB. This concerns in particular goods made to the customer's specification or clearly tailored to personal needs.
